Missing Scuba Dive

Emergency responders stage at the Yacht Basin marina east of Helena as search and rescue teams look for a missing diver near Cemetery Island on Canyon Ferry Lake in June. Searchers found the body of scuba diver Jesse Hubbell on June 19, two days after he disappeared in 60 feet of water.

The wife of the diver who drowned in Canyon Ferry Reservoir in June is seeking investigative materials that could be relevant to any future civil lawsuits over her husband's death.

Ellen Hubbell filed a petition for the information because she believes Jesse Hubbell's scuba diving equipment was "improperly serviced or otherwise defective," according to documents filed in district court. She is asking for all investigative materials related to her husband's death, including "reports, notes, photos, videos and interviews that are in the possession of Lewis and Clark County and the City of Helena."

Jesse Hubbell died while he was filming a video for John Mues, a Navy veteran with diving experience who is seeking the Democratic nomination to run against Republican U.S. Sen. Steve Daines in next year's election.

Mues and Jesse Hubbell were at the surface in at least 60 feet of water while two other members of the film crew and Ellen Hubbell were in a nearby boat, Capt. Kevin Wright of the Lewis and Clark County Sheriff's Office said in June. Jesse Hubbell went under and Mues attempted unsuccessfully to assist him. Mues was later transported to the hospital with non-life threatening injuries sustained during the rescue attempt.
