UPDATE: In November 2018, Jeffrey Scribner had all charges dropped by prosecutors.

A 38-year-old Helena man is accused of raping a sleeping woman at a local motel.

Jeffrey James Scribner is being charged with sexual intercourse without consent.

On July 30, 2017, an officer was dispatched to a report of a man having sexual intercourse with a woman without her consent. The victim told the officer that she had met Scribner through a mutual acquaintance and had stayed in an extra bed in Scribner's motel room the night before. 

She told the officer she fell asleep as soon as she got into the room and woke up to find her clothes partially removed and Scribner on top of her having sexual intercourse with her, according to court documents.

The documents say she told Scribner "this is not okay" but he did not stop. She kneed him in the groin, but he still attempted to have sexual intercourse without consent, the documents say. 

The woman escaped and told a friend. Scribner told an officer the sex had been consensual, according to a court affidavit. 

All suspects are considered innocent until proven guilty.
