A 40-year-old Helena man is being charged with aggravated DUI.
Samuel Horpestad is accused of his fourth DUI after allegedly bumping into an off-duty law enforcement officer’s car in a grocery store parking lot.
A Helena police officer arrived at the scene and made contact with Horpestad, who then agreed to participate in sobriety tests, according to court documents.
Horpestad failed to give a breath sample. The officer noted that Horpestad had bloodshot eyes, slurred speech, slow movements and was unsteady on his feet, and found that was suspicious enough to arrest him.
