A Helena man is accused of preventing a former partner from leaving his home.

Richard Allen Smith, 58, is being charged with aggravated kidnapping, assault with a weapon and two felony counts of partner or family member assault.

A police officer was dispatched to a call about an altercation between two people early Monday morning on Logan Street. The officer found that Smith was involved in the altercation and recognized him from previous incidents, according to court documents.

The victim told the officer she had gone to Smith’s apartment to retrieve her belongings, but Smith then refused to let her leave for more than a day and threatened her with bodily injury multiple times, according to court documents. She told officials he was holding a knife by his side. 

Smith allegedly assaulted the victim, striking her multiple times and biting her ear. Smith also allegedly strangled the victim to the point where her vision went hazy.

Smith admitted to stopping the victim from leaving the apartment but denied assaulting her, according to court documents.
