Two Helena men are accused of breaking into a trucking company to steal candy from a vending machine. The duo is jailed on felony charges of burglary.
Court documents say the men stayed the night in a building on the 1500 block of Blaine Street. After breaking into the building, the men allegedly damaged a vending machine while removing candy. They also stole food from a refrigerator early Saturday morning, the documents state.
Police found one of the men, Brian Smith, 44, nearby in his vehicle. Smith, who smelled of alcohol, admitted to drinking a pint of vodka, court documents say. Smith, who is on probation for felony driving under the influence, faces a new charge of DUI. He has four prior DUI convictions.
Smith's blood-alcohol concentration was twice the legal limit, the documents state.
His accomplice, Lance Calvin Greenhalgh, is accused of partaking in the stolen candy and other foods. Greenhalgh told officers he spent the night the building with Smith.
