A Helena man is accused of driving under the influence of alcohol with two children under age 14 in the vehicle.
Seth Michael Bergan, 37, was charged with felony criminal child endangerment, which carries a penalty of up to 10 years in prison if convicted.
On Thursday afternoon, Helena police officers responded to a call about a swerving car in the 2300 block of North Montana Avenue.
Officers made contact with the driver, Bergan, as he pulled over to the side of the road. Bergan had alcohol on his breath, glossy eyes and moderately slurred speech as officers spoke with him, according to court documents.
Bergan allegedly admitted to consuming alcohol earlier in the day. Officers conducted roadside tests that showed indicators of impairment, according to court documents.
Bergan submitted to a breath sample, which indicated a blood alcohol concentration of 0.288.
