Two Helena men were arrested following an alleged altercation early Wednesday.

John Paul Warner, 35, and Richard Allen Smith, 57, both face felony charges of assault with a weapon. Warner also faces a misdemeanor count of obstructing. 

Helena police responded to the 500 block of Logan Street where they encountered Smith and allege that they observed Warner leaving the scene and failing to follow an order to get on the ground, court documents say. Warner was later captured several blocks away.

Warner reportedly told authorities that he and his roommate approached the victim, who they believed had been trespassed from the property, to ask him to leave. The victim alleges that Warner struck him with a flashlight causing an injury, court documents say.

Smith also reportedly told authorities that he approached the victim to ask him to leave. An altercation ensued after he says the victim struck his roommate, according to court documents.

The arresting officer alleges that in viewing surveillance video, Smith used a cast on his hand from a previous injury to strike the victim and continued “his assault after defending himself from the threat,” court documents say.
